IACNS 2024 Legislative Mid-Session General Assembly Update

Legislators have returned from mid-session and are back to finish this year’s legislative session. To recap, the session started on January 8th with roughly 1,750 bills and now stand with only 220 remaining active. The session is set to end on March 15th, although many are anticipating an earlier date. House bills that were passed before the break have begun to be heard in Senate committees and similarly, Senate bills that were passed before the break have begun to be heard in the House.

Listed below are some of the bills related to APRN practice.

SB 45 (Trauma Informed Care, or TIC) - In its current state this bill would require all nurses to complete training in TIC. There are many challenges with this bill as it is currently written, please consider reaching out to your legislators if you haven’t already done so.

 SB 169 (Child Caring Institutions & Group Homes)- APRNs have been added to the list of "licensed professionals”. 

HB1216 (Medical Services for Certain Detainees) allows for an APRN to exam a detainee, but only a "physician" can sign the application for detention form (based on the exam performed by the APRN). CAPNI has been working diligently with lobbyist to get this changed so that the APRN can sign the detention form, but thus far efforts have not been successful. 

HB 1059 (Advanced Practice Registered Nurses). This bill has died. The bill authored by Rep. Cindy Ledbetter and co-authored by Rep. Ben Smaltz, Rep. Robb Greene, Rep. Victoria Garcia Wilburn was drafted to remove the requirement that APRNs practice under a collaborative agreement. The bill was assigned to the House Public Health Committee, but the Chair of the Committee (Rep Brad Barrett) chose not to schedule it for a hearing.

HB 1238 (Competency to Stand Trial) Allows a PMH APRN to assist the court in determining competency. Strikes "physician only" language.
